Understanding DOL Form WH-347 & Davis-Bacon Prevailing Wages

A practical guide for contractors, subcontractors, and payroll clerks executing federally funded construction contracts under 29 CFR § 5.5.

What is DOL Form WH-347?

Form WH-347 is the official U.S. Department of Labor (DOL) payroll reporting form used by contractors and subcontractors to submit weekly certified payroll records on federal and federally assisted construction projects.

Under the Davis-Bacon and Related Acts (DBRA), any contract exceeding $2,000 requires all laborers and mechanics on the site of work to be paid no less than the locally prevailing wage rate and bona fide fringe benefits determined by the Secretary of Labor.

Weekly Filing Mandate: Certified payrolls must be submitted weekly to the contracting agency within 7 calendar days after the regular payment date of the payroll period.

How Prevailing Wage & Fringe Math Works

Every Davis-Bacon wage determination specifies two distinct wage components for each trade classification:

  • Basic Hourly Rate: The minimum cash wage that must be paid per hour worked.
  • Bona Fide Fringe Rate: Additional compensation required per hour, which can be satisfied via employer contributions to qualified benefit plans, paid in cash as "cash in lieu," or a combination.

The Overtime Fringe Rule: Overtime (1.5×) is calculated on the basic hourly rate. However, fringe benefits are paid at straight time for all hours worked--including overtime hours.

Base Shortfalls: If your cash wage is less than the prevailing base rate, bona fide fringe contributions cannot cure the shortfall--cash wages must be increased.

Audit Red Flags & Statutory Penalties

Failure to properly compute and document certified payroll can result in severe enforcement actions under 29 CFR § 5.5 and the Copeland Act:

  • Withholding of Contract Funds: The contracting agency or DOL may freeze contract disbursements to satisfy unpaid wages.
  • Restitution Payments: Contractors are personally liable for back wages owed to workers plus statutory interest.
  • 3-Year Federal Debarment: Contractors found in willful violation are barred from bidding on federal contracts for up to 3 years.
Statement of Compliance: Each weekly submittal requires a signed Statement of Compliance. Falsification is a federal crime under 18 U.S.C. § 1001.

Frequently Asked Questions (FAQ)

Who is required to submit Form WH-347?

Prime contractors and all lower-tier subcontractors performing work on federally funded or federally assisted construction contracts subject to the Davis-Bacon Act or Related Acts exceeding $2,000.

What qualifies as a "Bona Fide" fringe benefit?

Contributions to health insurance, life insurance, pension/401(k) retirement plans, vacation/holiday funds, and DOL-certified apprenticeship programs. Mandatory employer taxes (such as FICA, Medicare, or workers' compensation) do NOT count as bona fide fringes.

What happens if our company does not offer health or retirement benefits?

You must pay the full required fringe benefit amount as taxable cash in lieu of fringes added directly to the employee's regular hourly cash wage on their weekly paycheck.

Is my company and worker data kept private on this website?

Yes. This calculator runs 100% locally in your web browser. No employee names, Social Security numbers, wage rates, or project records are ever transmitted to or stored on our servers.

What is the difference between Free and Pro?

The core calculation engine, fringe shortfall checks, and raw CSV exports are completely free forever. The Pro Active Project Pass ($29/mo) unlocks official unwatermarked WH-347 PDF drafts, authorized Statement of Compliance title blocks, multi-worker crew importing, and calendar reminders.

Can I use this for state prevailing wage projects?

Many states (e.g. California DIR, New York Article 8, Washington L&I) enforce their own prevailing wage laws and submission portals. While the mathematical principles are identical, always verify your specific state agency's certified reporting guidelines.
